Tree Preservation Order TPO34

Aberdeenshire Council have issued a Tree Preservation Order for Bowling Green Road, Turriff.

The new Tree Preservation Order will revoke the Banff & Buchan District Council (B&BDC) Tree Preservation Order No. 21 (1989) Romanno, Bowling Green Road, Turriff. The area of the order remains the same but will more accurately classify the area as a woodland.

The Notice

TOWN AND COUNTRY PLANNING (SCOTLAND) ACT 1997 (as amended)

ABERDEENSHIRE COUNCIL

TREE PRESERVATION ORDER NUMBER AC TPO 34 (2016)  Bowling Green Road, Turriff

Notice is hereby given that Aberdeenshire Council have made the above Order in terms of the

Town and Country Planning (Tree Preservation Order and Trees in Conservation Areas)

(Scotland) Regulations 2010 in respect of trees at the above location.

This Order, if confirmed, will revoke B&B DC TPO 21 (1989)

Any person wishing to make an objection or representation in terms of said Order should do so in

writing within 28 days of the date of receipt of this Notice.  Such objections or representations

should be in accordance with Regulation 5 of the Town and Country Planning (Tree Preservation

Order and Trees in Conservation Areas) (Scotland) Regulations 2010.  Any representations

received in this respect will be given due consideration.  The Order requires to be confirmed within

a period of six months.  The decision as to whether the Order is confirmed, with or without

modification, or is allowed to lapse, rests with the Formartine Area Committee.

I enclose a copy of the Map pertaining to the Order and Regulation 5. Further details relating to the

new Order (and that existing) are available on request.

ABERDEENSHIRE COUNCIL

TOWN & COUNTRY PLANNING (SCOTLAND) ACT 1997 (as amended)

TOWN AND COUNTRY PLANNING (TREE PRESERVATION ORDER AND TREES

IN CONSERVATION AREAS) (SCOTLAND) REGULATIONS 2010

ABERDEENSHIRE COUNCIL HEREBY GIVE NOTICE that they have made the following Tree Preservation Order in exercise of the powers conferred on them by the above Act and of all other powers enabling them to do so.

If confirmed, this Order will revoke the Banff & Buchan District Council (B&BDC) Tree Preservation Order No. 21 (1989) Romanno, Bowling Green Road, Turriff.

Certified copies of the Order with accompanying map can be viewed, at the council offices at Towie House, Manse Road, Turriff, AB53 4AY and Woodhill House, Westburn Road, Aberdeen AB16 5GB, between the hours of 8.45am and 5.00pm, Monday to Friday.

The new Order become effective as from the date specified in the Order and continue in force until (a) the expiration of a period of six months beginning with the date on which the Order was served; or (b) the date on which the Order is confirmed, whichever first occurs.

Representations relating to the Order may be made by any person, to the planning authority at the offices stated above no later than 28 days following publication of this notice. Representations must be made in writing, giving reasons and specifying the particular trees, groups of trees, or woodlands in respect of which they are made.

STATEMENT OF REASONS FOR MAKING THE ORDER

As part of a review of Tree Preservation Orders across their administrative area, Aberdeenshire Council have reviewed the original Tree Preservation Order B&BDC No. 21 (1989), served on an area of ground adjacent to the property known as Romanno, Bowling Green Road, Turriff.  Aberdeenshire Council consider that this small area of woodland continues to make a valuable contribution to the amenity and character of this area of Turriff and as such should be protected in the long term.

The area of ground covered by the existing Order remains unchanged but the format  has been varied to more accurately classify the area as a woodland.

The new Order has been served on relevant parties.

 

Regulation 5

THE TOWN AND COUNTRY PLANNING (SCOTLAND) ACT 1997 TOWN AND COUNTRY PLANNING (TREE PRESERVATION ORDER AND TREES IN CONSERVATION AREAS) (SCOTLAND) REGULATIONS 2010

Representations – Regulation 5

5 (1) Representations may be made to the planning authority with respect to a tree preservation order by –

(a) an interested person by the date specified in the notice given under regulation 4(1) (d); and

(b) any other person by the date specified in the notice given under regulation 4(1) (b).

5 (2) Every such representation must be made in writing, state the grounds thereof, and specify the particular trees, groups of trees, or woodlands in respect of which it is made.

5 (3) The planning authority must consider any representations made in accordance with this regulation before the tree preservation order is confirmed.

If you wish to make any representation to Aberdeenshire Council about the order you have 28 days from the date of receipt of the Notice which is dated 18 May 2016.
